TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the websites, online forms, appointment-booking systems, text messaging services, estimates, invoices, and automotive services offered by Diamond Garage LLC (“Diamond Garage,” “we,” “us,” or “our”).

By accessing our website, submitting a form, requesting a quote, scheduling an appointment, paying a deposit or invoice, or authorizing us to perform services, you agree to these Terms and our Privacy Policy.

Please do not use the Services or authorize work if you do not agree to these Terms.

1. About Diamond Garage

Diamond Garage LLC provides automotive appearance and protection services, which may include:

  • Automotive window tinting;

  • Paint protection film (“PPF”);

  • Ceramic coatings;

  • Paint correction;

  • Vehicle detailing and preparation;

  • Film removal;

  • Related automotive services; and

  • Other services identified in a written estimate, work order, invoice, or booking confirmation.

Specific services, materials, prices, warranties, and completion estimates will be described in the applicable quote, work order, invoice, or other written communication.

2. Eligibility and Authority

You must be at least 18 years old and legally capable of entering into a binding agreement to schedule or authorize Services.

By providing a vehicle to Diamond Garage, you represent that:

  1. You are the vehicle’s owner or have the owner’s permission to authorize the requested work;

  2. You have authority to agree to these Terms;

  3. The information you provide about the vehicle is accurate; and

  4. No lease, financing agreement, insurance requirement, manufacturer restriction, or other obligation prevents the requested work.

You are responsible for obtaining any necessary permission from a vehicle owner, leasing company, financing company, fleet manager, insurer, or other interested party.

3. Quotes and Estimates

Unless expressly identified as a fixed price, all quotes and estimates are based on the information available when the quote is provided.

Pricing may change after an in-person inspection if we discover circumstances such as:

  • Existing tint, film, coating, adhesive, or residue requiring removal;

  • Contamination, oxidation, scratches, chips, dents, cracks, repainting, bodywork, or clear-coat failure;

  • Aftermarket modifications;

  • Unusual body panels, trim, sensors, accessories, or vehicle dimensions;

  • Excessive dirt, pet hair, debris, biological material, or other conditions requiring additional preparation;

  • Prior workmanship that must be removed, corrected, or worked around; or

  • Any condition that makes the requested service more difficult, time-consuming, or risky.

We will attempt to obtain your approval before performing materially additional work. If you decline additional work that is reasonably necessary, we may refuse or discontinue the service.

A quote does not reserve an appointment unless a booking is confirmed and any required deposit has been paid.

4. Appointments, Deposits, Cancellations, and Rescheduling

Appointments are subject to availability and are not confirmed until you receive confirmation from Diamond Garage.

We may require a deposit to reserve labor, materials, or appointment time. The amount and any applicable cancellation or rescheduling conditions will be disclosed at the time of booking, on your invoice, or in your booking confirmation.

Unless otherwise stated in writing:

  • Deposits are applied toward the final balance;

  • Appointment changes are subject to availability;

  • Repeated rescheduling, late cancellation, failure to appear, or failure to deliver the vehicle at the agreed time may result in loss of the deposit;

  • Special-order materials, custom film, custom colors, and other nonreturnable materials may require nonrefundable payment;

  • Arriving late may shorten the available appointment time or require rescheduling; and

  • We may cancel or reschedule work because of staffing, equipment issues, material availability, unsafe conditions, emergencies, or other circumstances outside our reasonable control.

Any cancellation, rescheduling, or deposit terms specifically stated in your booking confirmation, estimate, work order, or invoice control over this general section.

5. Vehicle Drop-Off and Collection

You must deliver the vehicle at the agreed time with sufficient fuel or charge for necessary movement and testing.

Before leaving the vehicle, you should:

  • Remove cash, valuables, firearms, medication, sensitive documents, and personal belongings;

  • Remove or secure child seats, loose accessories, dash-mounted equipment, and fragile items;

  • Inform us of alarms, immobilizers, special starting procedures, mechanical issues, electrical issues, warning lights, leaks, battery concerns, or other relevant conditions;

  • Provide working keys, access cards, wheel-lock keys, and any codes reasonably required to perform the Services; and

  • Identify any areas of concern or pre-existing damage.

Diamond Garage is not responsible for the loss of unsecured personal property left in the vehicle except to the extent caused by our intentional misconduct or gross negligence.

You authorize Diamond Garage and its personnel to unlock, start, operate, move, inspect, photograph, scan, test, and store the vehicle as reasonably necessary to perform or evaluate the Services.

You are responsible for arranging transportation after drop-off and timely collection after completion unless Diamond Garage separately agrees to provide transportation.

6. Pre-Existing Vehicle Conditions

Automotive appearance services may reveal, worsen, or be affected by pre-existing conditions that are not visible before work begins.

These conditions may include:

  • Rock chips, scratches, swirl marks, dents, cracks, pitting, oxidation, stains, corrosion, or clear-coat failure;

  • Repainted panels or poorly bonded paint;

  • Loose trim, seals, moldings, emblems, sensors, wiring, cameras, antennas, defroster lines, or interior panels;

  • Brittle, aged, aftermarket, damaged, or improperly installed components;

  • Prior tint, PPF, vinyl, coatings, adhesive, or repair work;

  • Contamination embedded in paint, glass, film, or interior materials;

  • Factory defects or manufacturer design limitations; and

  • Mechanical, battery, electrical, software, or electronic problems unrelated to our work.

We may document the vehicle’s condition through photographs, videos, inspection notes, or electronic records before, during, and after service.

Diamond Garage is not responsible for pre-existing defects or for damage resulting from a pre-existing condition, defective component, prior repair, improper repaint, aged material, manufacturer defect, or aftermarket modification, except to the extent directly caused by our failure to exercise reasonable care.

7. Window Tint Services

7.1 Shade Selection and Legal Compliance

Tint laws vary by state, vehicle type, window, medical status, and other circumstances. The customer is responsible for selecting a film shade and configuration that complies with all applicable laws where the vehicle will be registered, driven, or inspected.

Diamond Garage may provide general information regarding commonly applicable tint limits, but such information is not legal advice and does not guarantee that a particular installation will be lawful in every jurisdiction or circumstance.

You are responsible for:

  • Understanding applicable tint laws;

  • Maintaining any required medical exemption or documentation;

  • Presenting exemption documentation to law enforcement or regulatory authorities;

  • Any citations, inspection failures, removal requirements, fines, fees, or other consequences associated with your chosen shade; and

  • Confirming that your insurer, leasing company, fleet manager, or vehicle manufacturer permits the installation.

We may refuse to install a requested film or shade at our discretion.

7.2 Installation Characteristics

Minor installation characteristics may be visible after tint installation, including:

  • Moisture pockets or haziness during curing;

  • Small water bubbles that disappear during curing;

  • Slight visual distortion;

  • Light gaps near window edges;

  • Film edges;

  • Variation around dots, frit, defroster lines, antennas, sensors, or raised areas;

  • Small particles that may be visible only under close inspection or specific lighting; and

  • Differences caused by factory glass, privacy glass, existing damage, or vehicle design.

These characteristics are not necessarily defects.

Curing time varies based on film type, weather, temperature, glass design, and installation location. You must follow all aftercare instructions, including restrictions on operating windows or cleaning the film.

7.3 Glass and Component Risks

Tint installation and removal require handling, cleaning, heating, and applying pressure to automotive glass and surrounding components.

Pre-existing chips, cracks, scratches, damaged defroster lines, brittle seals, prior adhesive, aftermarket glass, and manufacturing defects may increase the risk of damage.

We are not responsible for failure of glass, defroster lines, antennas, sensors, trim, or other components caused by a pre-existing defect or condition that could not reasonably have been detected before service.

Special installations involving sunroofs, panoramic roofs, T-tops, unusually large glass, laminated glass, aftermarket glass, or previously damaged glass may require a separate acknowledgment or waiver before work begins.

8. Paint Protection Film and Vinyl Film

PPF and other vehicle films are intended to reduce certain types of surface damage but cannot prevent all rock chips, impacts, scratches, stains, dents, paint damage, corrosion, accidents, vandalism, environmental damage, or normal wear.

You acknowledge that:

  • Existing paint defects, chips, scratches, bodywork, contamination, and texture may remain visible beneath the film;

  • Film does not repair existing damage;

  • Seams, edges, relief cuts, joints, and partial-panel coverage may be visible;

  • Some edges cannot be wrapped because of panel design, access limitations, sensors, trim, risk of damage, or manufacturer construction;

  • Film appearance may vary on repainted, repaired, textured, matte, satin, or damaged surfaces;

  • Installation fluid, haze, moisture pockets, or small bubbles may be visible during curing;

  • Film may change the appearance, gloss, texture, or color of the covered surface;

  • Film may not adhere properly to failing paint, poorly cured paint, touch-up paint, body filler, ceramic coatings, waxes, sealants, or contaminated surfaces; and

  • Removing film may expose or pull paint that was previously damaged, improperly repaired, poorly bonded, repainted, or otherwise defective.

Diamond Garage may decline installation on a panel or vehicle that we believe presents an unreasonable risk.

9. Ceramic Coatings and Paint Correction

Ceramic coatings are designed to enhance appearance and make routine maintenance easier. They do not make a vehicle scratch-proof, chip-proof, stain-proof, water-spot-proof, corrosion-proof, maintenance-free, or immune from damage.

Coating performance and durability depend on factors including:

  • Vehicle storage;

  • Mileage and driving conditions;

  • Washing methods;

  • Environmental exposure;

  • Water quality;

  • Chemical exposure;

  • Maintenance products;

  • Accident or body repair history; and

  • Compliance with required maintenance and inspection procedures.

Paint correction removes or reduces certain visible defects by polishing the vehicle’s clear coat. Not all defects can be safely removed. Deep scratches, chips, etching, thin paint, failing clear coat, prior repairs, and other conditions may remain.

We may recommend against further correction if additional polishing could create an unreasonable risk of damaging the paint or clear coat.

You must follow all cure-time, washing, chemical exposure, and maintenance instructions provided after service.

10. Service Completion Times

Any completion date or time is an estimate and is not guaranteed unless expressly stated in writing.

Completion may be delayed by:

  • Vehicle condition;

  • Installation complexity;

  • Necessary curing time;

  • Additional customer-approved work;

  • Material or equipment issues;

  • Weather or environmental conditions;

  • Staffing or scheduling changes;

  • Manufacturer or supplier delays; or

  • Circumstances outside our reasonable control.

We will make reasonable efforts to communicate material delays. Diamond Garage is not responsible for rental vehicle costs, transportation costs, missed appointments, loss of vehicle use, lost income, or other indirect costs caused by a reasonable service delay, except where prohibited by law.

11. Customer Inspection and Concerns

You should inspect the vehicle when it is returned and promptly notify Diamond Garage of any concern.

Some conditions can only be accurately evaluated after the applicable curing period. You must allow the film, coating, adhesive, or other material to cure for the period specified in your aftercare instructions before requesting corrective work for curing-related conditions.

Unless a different period is provided in writing, visible concerns that are not related to curing should be reported within 48 hours after vehicle pickup.

Reporting a concern does not automatically establish that the concern is covered by a warranty. We must be given a reasonable opportunity to inspect the vehicle and determine the cause.

Do not allow another shop or person to remove, alter, repair, reinstall, polish, coat, or otherwise work on the area in question before Diamond Garage has inspected it. Unauthorized third-party work may limit or void available remedies.

12. Warranties

Certain products may include a manufacturer warranty. Warranty terms, duration, exclusions, required registration, maintenance obligations, and available remedies are determined by the applicable manufacturer warranty documentation.

Diamond Garage does not expand or modify a manufacturer’s warranty unless we expressly do so in a signed written agreement.

Unless otherwise required by law or stated in writing:

  • Warranty service requires proof of purchase;

  • The vehicle must be made reasonably available for inspection;

  • The customer must follow all aftercare and maintenance instructions;

  • Warranty coverage is limited to covered defects in materials or workmanship;

  • Warranty coverage does not include accidents, impacts, misuse, neglect, improper washing, environmental contamination, vandalism, third-party work, normal wear, pre-existing damage, paint failure, glass failure, or manufacturer defects;

  • Warranty coverage does not reimburse transportation, towing, rental vehicles, loss of use, lost income, or other incidental expenses; and

  • The remedy may be limited to repair, replacement, removal, or reinstallation of the affected product or service.

Any separate written warranty supplied with your service is incorporated into these Terms. If there is a conflict, the more specific written warranty controls for the covered warranty issue.

13. Payments and Unpaid Vehicles

Payment is due according to the applicable estimate, invoice, work order, or booking confirmation.

Unless Diamond Garage agrees otherwise in writing:

  • The full remaining balance is due before the vehicle is released;

  • We may accept payment through third-party processors;

  • You authorize the processor to charge the payment method you provide for approved deposits and balances;

  • You are responsible for applicable taxes and approved additional charges;

  • Returned payments, chargebacks, or disputed payments may result in additional lawful fees and collection activity; and

  • You may not withhold payment because of a concern without first giving Diamond Garage a reasonable opportunity to inspect and address it.

We may retain possession of a vehicle when permitted by applicable law until amounts due for authorized work are paid.

Vehicles not collected after completion may be subject to reasonable storage charges after notice, as permitted by law. Continued failure to collect a vehicle may result in additional remedies available under Nevada law.

14. Chargebacks and Payment Disputes

Before initiating a chargeback or payment dispute, you agree to contact Diamond Garage and provide a reasonable opportunity to investigate and address the issue.

This section does not waive any rights you have under applicable payment-card rules or consumer-protection law. Providing false information in a chargeback, claiming that authorized services were unauthorized, or retaining the benefit of completed work without payment may result in collection efforts or legal action.

15. Photographs and Recordkeeping

Diamond Garage may photograph or record the vehicle, its condition, and the work performed for:

  • Inspection and documentation;

  • Quality control;

  • Warranty administration;

  • Training;

  • Dispute resolution; and

  • Internal business records.

We may use photographs or videos for advertising, social media, portfolio, or promotional purposes only when the content does not display readily identifying personal information such as your face, home address, documents, or clearly readable license plate, unless you separately authorize such use.

You may ask us not to use images of your vehicle for promotional purposes by notifying us before the vehicle is collected.

16. Website Accounts, Forms, and Submissions

You agree to provide accurate, current, and complete information when submitting a form, requesting a quote, booking an appointment, applying for employment, or communicating with us.

You may not:

  • Submit false or misleading information;

  • Impersonate another person;

  • Attempt to access another person’s information;

  • Upload malware, unlawful content, or materials that infringe another person’s rights;

  • Interfere with the website or its security;

  • Scrape, copy, reverse engineer, or misuse the website;

  • Use automated systems to overload or disrupt the Services; or

  • Use the Services for fraud, harassment, abuse, or any unlawful purpose.

We may restrict or terminate access to the website or online Services when reasonably necessary to protect Diamond Garage, our customers, or our systems.

17. Reviews, Messages, Photos, and Other User Content

When you voluntarily submit a review, testimonial, photograph, message, comment, or other content for publication, you represent that:

  • You created the content or have permission to submit it;

  • The content is accurate to the best of your knowledge;

  • The content does not violate another person’s privacy, copyright, trademark, or other rights; and

  • The content is not unlawful, threatening, fraudulent, defamatory, or malicious.

You grant Diamond Garage a nonexclusive, worldwide, royalty-free license to reproduce, display, format, and share content that you intentionally provide for public or promotional use.

This license does not give Diamond Garage ownership of your content and does not apply to private customer communications except as necessary to provide the Services, maintain records, protect legal rights, or comply with law.

18. SMS/Text Messaging Program

Diamond Garage LLC offers an SMS messaging program for customers and prospective customers who separately opt in to receive text messages.

Depending on the consent selected, messages may include:

  • Responses to quote requests;
  • Appointment confirmations and reminders;
  • Vehicle drop-off and pickup instructions;
  • Service-status updates;
  • Payment, invoice, and warranty information;
  • Customer-support communications; and
  • Recurring promotional and marketing messages, including special offers, discounts, promotions, and service announcements.

Consent to receive promotional or marketing text messages is optional and is not a condition of purchasing any goods or services from Diamond Garage LLC.

You must be at least 18 years old and authorized to use the mobile telephone number provided to enroll in the SMS program.

Message frequency varies. Message and data rates may apply.

Reply STOP to opt out of text messages at any time. Reply HELP for assistance. After submitting an opt-out request, you may receive one final message confirming your removal from the SMS program.

Wireless carriers are not liable for delayed or undelivered messages.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging opt-in data and consent will not be sold, rented, transferred, or shared with any third parties.

You may unsubscribe from promotional emails by using the unsubscribe link included in the email.

19. Third-Party Services

Our Services may use or link to third-party platforms, including payment processors, booking providers, customer relationship management systems, communications providers, map services, social networks, analytics services, advertising platforms, and warranty providers.

Those third parties operate under their own terms and privacy practices. Diamond Garage is not responsible for third-party websites, platforms, outages, security practices, content, or services that we do not control.

References to a third-party product or platform do not constitute a guarantee or endorsement of every aspect of that third party’s services.

20. Intellectual Property

The Diamond Garage name, branding, logos, website design, original text, photographs, graphics, videos, and other original materials are owned by Diamond Garage or used with permission.

Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, publicly display, or create derivative works from our materials without written permission.

You may use the website for personal, noncommercial purposes related to evaluating or purchasing our Services.

21. Disclaimer of Website Information

Website content is provided for general informational purposes. Vehicle designs, service requirements, pricing, product availability, film specifications, warranty terms, legal requirements, and manufacturer information may change.

We do not warrant that all website information will always be complete, current, error-free, or applicable to every vehicle.

A website description does not replace the specific terms shown in your estimate, work order, invoice, manufacturer warranty, aftercare instructions, or signed acknowledgment.

22. Disclaimer of Warranties

Except for warranties expressly provided in writing and rights that cannot legally be waived, the website and online Services are provided on an “as available” basis.

To the fullest extent permitted by law, Diamond Garage disclaims implied warranties relating solely to the website, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

Nothing in these Terms excludes or limits an express written product or workmanship warranty provided to you or any consumer right that cannot lawfully be excluded.

23. Limitation of Liability

To the fullest extent permitted by law, Diamond Garage will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost business, loss of use, missed opportunities, rental costs, or transportation expenses arising from the website or Services.

Where Diamond Garage is legally responsible for a covered claim, our aggregate liability will not exceed the amount you paid Diamond Garage for the specific service giving rise to the claim, except where a different limitation is prohibited by law.

These limitations do not apply to liability that cannot lawfully be limited, including liability for intentional misconduct, fraud, gross negligence, or personal injury caused by conduct for which limitation is prohibited.

24. Indemnification for Misuse

To the extent permitted by law, you agree to be responsible for losses, claims, or expenses resulting from:

  • Your unlawful misuse of the website or Services;

  • False information you provide;

  • Your lack of authority to authorize work on a vehicle;

  • Content you submit that violates another person’s rights; or

  • Your material violation of these Terms.

This section does not require a consumer to indemnify Diamond Garage for Diamond Garage’s own negligence, intentional misconduct, or violation of law.

25. Governing Law and Venue

These Terms and disputes arising from them are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, any court proceeding arising from these Terms or the Services must be brought in a state or federal court with jurisdiction in Clark County, Nevada.

Before filing a lawsuit, the parties agree to make a good-faith attempt to resolve the dispute by providing written notice describing the issue and requested resolution. This informal resolution requirement does not prevent either party from seeking urgent injunctive relief, filing in small claims court, meeting a legal filing deadline, or exercising a right that cannot lawfully be restricted.

26. Changes to the Services or Terms

We may update these Terms to reflect changes in our Services, business practices, technology, or legal obligations.

The updated Terms will be posted with a revised “Last Updated” date. Material changes will apply prospectively unless applicable law permits otherwise.

The version in effect when you authorize a specific service will generally govern that transaction, together with any estimate, work order, invoice, warranty, waiver, or acknowledgment applicable to that service.

27. Electronic Communications and Signatures

You consent to receive agreements, estimates, invoices, disclosures, booking confirmations, and other records electronically.

Checking an acceptance box, clicking an acceptance button, signing electronically, paying an invoice, or otherwise taking an action that clearly indicates agreement may constitute your electronic acceptance.

You may request a printable copy of these Terms or transaction records by contacting us.

28. Assignment

You may not transfer your rights or obligations under these Terms without our written consent.

Diamond Garage may transfer these Terms as part of a merger, acquisition, sale of assets, restructuring, or other business transfer, subject to applicable law.

29. Severability

If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted or removed to the minimum extent necessary. The remaining provisions will remain in effect.

30. No Waiver

Failure to enforce a provision of these Terms does not waive the right to enforce it later.

A waiver is effective only when made in writing by an authorized representative of Diamond Garage.

31. Entire Agreement and Order of Priority

These Terms, our Privacy Policy, and any applicable estimate, booking confirmation, work order, invoice, warranty, aftercare instructions, acknowledgment, or signed waiver form the agreement between you and Diamond Garage regarding the applicable Services.

If documents conflict, the more specific transaction document controls over these general Terms with respect to the subject it specifically addresses.
